As you know, SONWEST CO., a Texas corporation, is the current “Declarant” under the Declaration of Condominium Regime for Sonterra I Condominiums, recorded as Document No. 2016002134 of the Official Public Records of Williamson County, Texas, as amended (collectively, the “Declaration”).
As permitted by the Declaration and Texas law, it is now time for all of the members of the Board of Directors of the Sonterra I Residential Condominium Community, Inc., a Texas nonprofit corporation (the “Association”), appointed by the Declarant to resign, and for the Owners to elect their replacements to the Board of Directors. The current Board of Directors has directed the President to call a special meeting of the members of the Association (the “Special Meeting”) and at the Special Meeting the members will vote to elect three (3) members to the Board. The one (1) candidate receiving the largest number of votes shall be elected to a three (3) year term, the one (1) candidate receiving the next largest number of votes shall be elected to a two (2) year term, and the candidate receiving the next largest number of votes shall be elected to a one (1) year term. We currently anticipate that the Special Meeting and election will be held on December 16, 2022. An official Notice of Special Meeting of Members will be sent to each Owner prior to the Special Meeting as required by the Declaration and the Bylaws of the Association.
In anticipation of the Special Meeting, the current Board of Directors extends to you the opportunity to nominate yourself or another Owner as a candidate for election to the Board of Directors. Nominations are open to any Member in good standing and should be made using the attached form. Please submit your nominations to Sonterra I Residential Condominium Community, Inc., c/o CONDO ONE Nomination, Attn: Manager, by: Email – email@example.com. The deadline for receipt of nominations is November 14, 2022. Please be advised that nominations may also be made from the floor during the Special Meeting. The Board of Directors may include the profile information received from the Members in the Special Meeting notice package and/or provide supplemental information by electronic communication.
We encourage your participation in the Association. As you know, the Association has important functions including: (i) budgeting for current and future expenses; (ii) communicating with Owners; and (iii) managing and collecting Assessments. However, in accordance with the Association’s governing rules, if you are not current on your assessments, you cannot run for a director position. Further, if you are more than forty-five (45) days late on your assessments, you may not vote.1
